These Terms of Service ("Terms") govern your access to and use of the Grace's Desire mobile application and website (collectively, the "Service"), operated by Elsen Technologies UG (haftungsbeschränkt), Fliederweg 7, 34212 Melsungen, Germany, represented by its managing director Florian Elsen ("we", "us", or "our"). By creating an account or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.
The Service contains sexual and explicitly adult content, including mature language and imagery. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account or use the Service. Use by minors is strictly prohibited. By creating an account you represent and warrant that you meet this age requirement.

You retain ownership of any content you voluntarily submit through the Service (e.g., story submissions). By submitting content you grant us a worldwide, non-exclusive, royalty-free licence to use, store, and display that content solely for the purpose of operating the Service.
We may remove user-submitted content where it objectively violates Section 3 of these Terms (Acceptable Use), applicable law, or the rights of third parties. We will inform you of the removal and the reason for it, except where we are legally prohibited from doing so or where immediate removal is necessary to prevent harm.
Grace's Desire follows a freemium model. Core features are free to use. Certain additional features require a paid subscription ("Premium"). All purchases are processed exclusively through the Apple App Store or Google Play — payment is handled entirely by Apple/Google, and we never receive, process, or store your payment details. We collect only the minimum personal data necessary to provide the Service, including your email address, username, password hash, and an optional date of birth for age verification. We also store a push notification token if you grant permission, and anonymised usage counts to improve the app. Full details are set out in our Privacy Policy.
Data processing is conducted under the legal bases of your consent, contract performance, and our legitimate interests, in accordance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
Interaction data (e.g., quiz completions, article views) may be used in anonymised and aggregated form to improve the Service. Such data cannot be traced back to individual users and is not shared with third parties in identifiable form.
We do not sell your personal data. The following third parties are involved in operating the Service:
If you are located in the European Economic Area, you have the following rights regarding your personal data: access, rectification, erasure, portability, objection/restriction, and the right to withdraw consent at any time. We implement appropriate technical and organisational measures to protect your data against unauthorised access, alteration, disclosure, or destruction. Passwords are hashed using Argon2id and all data in transit is encrypted via TLS. No system is completely secure, however, and we cannot guarantee absolute security.
Your personal data is retained for as long as your account is active or as necessary to comply with legal obligations. When you delete your account all personal data is permanently removed within 30 days, subject to backup retention as described in our Privacy Policy.
You may delete your account at any time from the Settings screen.
For minor or first-time violations of these Terms, we will generally issue a warning and an opportunity to correct your conduct before taking further action. We may suspend or terminate your account without prior notice only where (a) the violation is serious (e.g. illegal content, harassment, fraud, security threats), (b) you have already been warned for similar conduct, or (c) immediate action is necessary to protect the Service or other users. Upon termination your right to use the Service ceases; Section 14 (Right of Withdrawal) applies in parallel where relevant.
What this is: As a consumer, you have a statutory right to withdraw from the contract you conclude with us by creating an account, within 14 days, without giving any reason — independent of, and in addition to, your ability to delete your account at any time.
Premium subscriptions: Premium purchases are separate contracts concluded directly between you and Apple or Google as the platform operator and are not part of the contract with us. Withdrawal from a Premium purchase is governed exclusively by Apple's and Google's own consumer terms and refund processes.
Free use of the app: The 14-day statutory right of withdrawal (§ 355 BGB) applies to the contract for use of the free Service from the day your account is created. This right may expire early if you expressly request that we begin providing the Service immediately and you acknowledge that you thereby lose your right of withdrawal once we have fully performed (§ 356 Abs. 5 BGB). We obtain this express request and acknowledgement separately from your general acceptance of these Terms, via a dedicated confirmation step at account creation; without it, your right of withdrawal continues to apply for the full statutory period.
Because the free Service involves no payment to us, exercising this right of withdrawal has, in practice, the same effect as deleting your account: we will deactivate your account and permanently delete your personal data in accordance with Section 12.

The Service is provided "as is" and "as available". We do not warrant uninterrupted or error-free operation of the Service.
We are liable without limitation for damages caused by intent or gross negligence, for injury to life, body, or health, and under the German Product Liability Act (Produkthaftungsgesetz).
For damages caused by ordinary negligence, we are liable only where we have breached a material contractual obligation (Kardinalpflicht) — i.e. an obligation whose fulfilment is essential to the proper performance of the contract and on whose compliance you may regularly rely. In such cases, our liability is limited to the foreseeable damage typical for contracts of this kind.
The above limitations do not apply to liability arising from the assumption of an express guarantee, or to mandatory statutory liability that cannot be excluded or limited by agreement.
These Terms are governed by the laws of the Federal Republic of Germany, without prejudice to any mandatory consumer-protection provisions of the law of your country of habitual residence, which remain unaffected (Art. 6 Rome I Regulation).
If you are a consumer resident in the EU, mandatory statutory rules on jurisdiction (in particular Art. 18 of Regulation (EU) No 1215/2012) determine where you may bring or be sued in legal proceedings; nothing in these Terms restricts those rights.
We may update these Terms from time to time. We will notify you of material changes via the app with reasonable advance notice. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please delete your account.
